International Users

What Information Does The Shade Store Collect?


The Shade Store collects data that you voluntarily provide on the Site through purchase transactions, the use of our “measure and install,” “to the trade,” free swatches, measures, and in-home consults, or similar features, when you register for an account, request a catalog, or check order status, or that you otherwise provide through phone, e-mail, website-based, chat, mail and phone/text interactions that you submit to us or provide to our sales associates through or in connection with the Site. The Shade Store Site may collect and store “personal information,” including “automatic information.”

“Personal information” is personally identifiable information about or related to you including, but not limited to, your name, company name, billing address, shipping address, email address, telephone number, credit card information, any designs or photographs you or our service providers save or upload on the Site, any personal preferences you choose to provide, transaction details, an assigned password to protect your privacy, and, with respect to trade accounts, your company website, among other things.

“Automatic information” is information that we may collect automatically when you interact with this Site, such as your IP address, browsing actions and patterns, location data, the type of computer you use, and the web browser you use. Automatic information also includes "cookies" and "web beacons." A "cookie" is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. Among other things, cookies provide a means for us to keep track of your online patterns and preferences. By understanding which areas of the Site you visit, cookies allow us to present information, products and services that are of personal interest. Most browsers are initially set up to accept cookies. "Web beacons", also known as clear GIFs or single-pixel GIFs, are small image files that we may place on web pages within this Site and within web-based email newsletters that we send. Working in conjunction with cookies, web beacons allow us to accurately count the number of unique users who have visited a specific web page and the number of times those web pages are displayed. We can also use web beacons to let us know how many people opened a web-based email newsletter.

How Does The Shade Store Use This Information?


The Shade Store uses this information to provide information on the products and services you are interested in, to provide order quotes, to introduce you to installers via our "measure and install" webpage, to provide information on the products and services that you have ordered or requested, to confirm, process and ship sales transactions, to send order and shipping confirmations, to provide order status information, to contact you with questions or communications about your order, to respond to your customer service inquiries, or to communicate with, and enlist installers, affiliate program participants, and other third parties to provide services in connection with the Site.

The Shade Store also uses this information to enhance and personalize your shopping experience, both online and in our showrooms, to advertise to you (including through our participation in data co-ops and digital advertising networks to deliver advertising that is tailored to your interests), to communicate with you for marketing and promotional purposes (including sending you a catalog, samples, targeted postal pieces, newsletters, or emails); to gauge the effectiveness of such promotional communications; to administer, analyze, and improve the effectiveness of our Site; to document our business activities (including vis a vis installers); and for archival and record retention purposes.

How Can You Access Your Information?


You may access and edit the personal information that is stored in your user account on this Site by signing or logging in on the Site. Simply click on “My Account” link from the home page and enter your email address and password to access your account. You can request password help at any time by clicking on the “forgot my password” link at which time we will email your password to the associated email address. You may also request to access, correct or delete personal information that you have provided to us at any time from our customer service representatives or by contacting us using the contact information below.

How Does The Shade Store Protect Your Information?


We have implemented physical, electronic and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. Please note that e-mail is not encrypted and is not considered to be a secure means of transmitting credit card information. While we strive to protect your personal information, we cannot guarantee or warrant that such information, during transmission through the Internet or while stored on our system or otherwise in our care, as the case may be, will be completely secure. Therefore, the provision of such information is done at your own risk. We shall have no liability for disclosure of your personal information due to errors, omissions or unauthorized acts of third parties during or after transmission.

When you create an online account on the Site and become a registered user, you will be asked to provide an accurate email address and create a password. You are responsible for keeping this password confidential and are urged (i) not to share your password or account information with others, (ii) to use a secure web browser, and (iii) to change your password from time to time. Does The Shade Store Disclose Your Information to Others?


We may share your personal information with our subsidiaries and/or affiliates.

We may also disclose personal information about you to third party service providers that act on our behalf (“Service Providers”). These Service Providers may provide a variety of services to us including, without limitation, processing credit card payments, providing website hosting, consulting or other technical services related to the Site, assisting us in fulfilling your transactions and customer service inquiries (including Zendesk- please note that personal information collected, stored, used, and/or processed by the Zendesk Group is collected, stored, used, and/or processed in compliance with the CCPA, as amended, and any regulations made under it), updating your customer profile information in the database, advertising (including Rakuten, which uses cookies and tracking devices for interest-based advertising and LiveRamp, with whom we share personal information for the purposes of digital targeting- for more information, see LiveRamp’s privacy policy, available at: https://liveramp.com/privacy/), marketing, and promotional material distribution (including data co-op members and social media companies to which we link on the Site, including links to our Facebook, Houzz, Instagram, Pinterest, and Twitter pages), providing data analytics (note that we use Hotjar in order to better understand our users’ needs and to optimize the Site. Hotjar is a technology service that helps us better understand our users’ experience (e.g., how much time they spend on which pages, which links they choose to click, etc.) and this enables us to build and maintain the Site with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. We may enter into strategic relationships with other companies (“Strategic Partners”) who offer products and services that may be of interest to you or which provide materials that are used in certain of our products. If you purchase products containing such Strategic Partner materials from us or otherwise request information on such Strategic Partners’ products or services, we may share your personal information with such Strategic Partner as part of our strategic relationship, in order to provide the information, products and services that you have requested or purchased. Our strategic partners are bound by contract to use the personal information we share with them only for the limited purposes for which we provide it to them and to take reasonable measures to protect the confidentiality, integrity and security of your personal information. They may not use or share your personal information in a manner that would be inconsistent with this Privacy Policy.

We may use and/or disclose to others aggregate information about your demographics and use of our Site in a manner that does not reveal your identity. We may also disclose personal information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may have breached our Terms of Use or who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, or those of other users of our Site or anyone else who could be harmed by such activities, or when we reasonably believe that the law requires us to do so.

We may transfer or disclose personal information in the event that The Shade Store and/or its subsidiaries or affiliates engages in a business transition, such as a merger, acquisition by another company, the sale of a business unit or assets, or other “change of control” transaction.

Tracking Technologies and Advertising.

  • We use the Meta Pixel to analyze user activity on our Site for remarketing and behavioral targeting. The Meta Pixel is triggered when you perform certain activities on the Site, and aids us in displaying Facebook ads to Facebook users who have visited our Site, or Facebook users who share certain characteristics with visitors to our Site. Meta and other third parties may use cookies, web beacons, and other storage technologies to collect information from the Site and from other internet websites, and use that information for the purposes of targeting ads and providing measurement services.   • We have also contracted with Yahoo to monitor certain pages of our Site for the purpose of reporting web traffic, statistics, advertisement “click-throughs,” and/or other activities on our Site. Can I Unsubscribe?


Yes. The Shade Store honors requests to unsubscribe or opt out from receipt of emails, newsletters and/or other promotional materials (including for emails that we permit other companies to send to their own list of customers or subscribers).

How Does The Shade Store Protect Children’s Privacy?


This Site is a general audience site. We do not knowingly or intentionally collect or maintain personally identifiable information from children under the age of thirteen and no part of this Site is targeted to attract anyone under the age of thirteen. If we become aware that we have collected personally identifiable information from a user of the Site who is under the age of thirteen, we will remove that child’s personal information from our files.

Motorized Window Treatment Integration With Google Home, Alexa, Nest, Apple Homekit (And Other Third-Party Devices)


Our motorized window treatments include a feature that allows you to control your window treatments through a mobile app called “The Shade Store,” available on Apple’s App Store and Google’s Play Store (the “TSS App”), or through third party connected devices, such as Google Home, Apple Homekit, Alexa, Nest, and others. The TSS App is managed and maintained by a third-party supplier and their data collection practices apply when you use the Apps. If you connect our motorized window treatments to a third-party device, we will automatically share information gathered about your use of the products, such as your name, shade positions, room names, and scenes. Please refer to the privacy policies of these third parties for more information about their data collection practices.

Your State Privacy Rights

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to: consumerinfo@theshadestore.com.

Virginia and Texas provide their state residents with rights to:

  • Access and delete certain personal information.
  • Data portability.

Selling/Sharing Personal Information


We may disclose your Personal Information to third parties in a manner that constitutes a sale or sharing for cross-context behavioral advertising (“sharing”) under the CCPA.
In the past twelve months, we have provided the following categories of information to third parties, as noted above, for this purpose:
  • Personal identifiers, such as unique personal identifiers, online identifiers, internet protocol addresses, device information and identifiers, and unique advertising identifiers and cookies; Internet and other electronic network activity information; geolocation information; characteristics of protected classifications under California or federal law; commercial information; and inference information.

We disclosed these categories of information to these third parties in order to market and advertise our products and services; perform analytics; and to maintain, improve, upgrade, or enhance our products or services.

Retention


We maintain your Personal Information for as long as necessary to fulfill our business purpose, to conduct business with you, or as necessary to comply with our legal obligations, resolve disputes, and enforce any agreements.

Notice of Financial Incentive


We may provide one-time promotions in the form of coupons or discounts in exchange for certain personal information including your name, email address, and zip code. The amount and terms of such offers will be presented to you at the time of the offer. You can terminate your participation by contacting us at the email address set forth below. The Right to Request Deletion You have the right to request the deletion of Personal Information we have collected from you, subject to certain exceptions.

The Right to Limit the Use of Your Sensitive Personal Information You have the right to direct us to limit our use or disclosure of your Sensitive Personal Information. We do not collect or process sensitive personal information for the purpose of inferring characteristics about consumers. We also do not disclose sensitive personal information for purposes other than those specified in section 7027(m) of the CCPA regulations promulgated by the California Privacy Protection Agency. Therefore, we do not offer consumers the option to limit the use of their sensitive personal information.
The Right to Correct In certain circumstances, you have the right to request correction of any inaccurate Personal Information.
The Right to Non-Discrimination You have the right not to receive discriminatory treatment for exercising these rights. However, please note that if the exercise of these rights limits our ability to process Personal Information, we may no longer be able to provide you our products and services or engage with you in the same manner.
Shine the Light Pursuant to Section 1798.83 of the California Civil Code, California residents may request certain information regarding and/or opt-out of our disclosure of personal information to third parties for their direct marketing purposes.
